How Probate Property Sales Work
Understanding the probate real estate process in California
Probate Filed
When someone passes away, their estate goes through probate court. An executor or administrator is appointed to manage the estate.
Property Listed
If the estate includes real property, it may be listed for sale. The court or the estate representative sets the terms; some sales require court confirmation.
Offer Made
Buyers submit offers to the executor. The offer must typically be at least 90% of the appraised value for full-authority sales.
Court Confirmation
Many sales require court confirmation. Other buyers can "overbid" at the hearing, so be prepared to increase your offer.
